USER AGREEMENT (PUBLIC OFFER)

for ordering, purchase, and delivery of goods via the Bureviy online store

 This Agreement is a public offer by the Seller to an indefinite number of persons to conclude an electronic sales contract for goods under the terms set out below. Acceptance (full and unconditional consent) to this Agreement occurs when an Order is placed on the Website and/or paid for, in accordance with the Law of Ukraine “On Electronic Commerce”. The Agreement is a public contract and a contract of adhesion within the meaning of the Civil Code of Ukraine. Law of Ukraine.

  1. Definitions

 1.1. Website — the Seller’s web resource, bureviy.shop, through which Orders are placed.

1.2. Goods — fencing equipment, apparel, and accessories, including items individually made to order (custom).

1.3. Order — a duly completed request by the Buyer on the Website to purchase Goods.

1.4. Buyer — a legally capable natural person aged 18+, a sole proprietor, or a legal entity that accepts the terms of this Offer.

1.5. Custom (made-to-order) production — manufacture of Goods taking into account the Buyer’s measurements/parameters/branding.

1.6. Other terms are used as defined by the legislation of Ukraine, in particular the Law of Ukraine “On Electronic Commerce”. Law of Ukraine.

  1. Subject of the Agreement

 2.1. The Seller undertakes to transfer title to the Goods to the Buyer, and the Buyer undertakes to accept and pay for the Goods under this Offer.

2.2. The Agreement governs: selection of Goods, ordering and payment, production (if applicable), delivery/collection, exchange/returns, warranty, and the Parties’ liability.

  1. Placing an Order

 3.1. The Buyer independently selects Goods on the Website, completes the Order form, and specifies the method of payment and delivery.

3.2. Prior to confirming the Order, the cart/checkout page displays the essential terms: product name, price, estimated production/dispatch time, and delivery/payment method and cost.

3.3. The moment of concluding an electronic contract is the acceptance of the Offer (clicking “Pay/Confirm order”, etc.) and/or making payment in accordance with the Law of Ukraine “On Electronic Commerce”. Law of Ukraine.

3.4. For custom items, the Buyer ensures the accuracy of measurements/specifications; if needed, the Seller provides measurement instructions.

  1. Price and Delivery of Goods

 4.1. Prices for Goods are indicated on the Website in hryvnias (UAH) and euros (EUR) with or without VAT (depending on the Seller’s status) and may additionally be displayed in other currencies for convenience. Settlement is made in the currency indicated on the payment page.

4.2. Payment methods: bank cards, Apple Pay/Google Pay, bank transfer, cash on delivery (if available).

4.3. Part of the assortment is made to order. The typical production lead time is up to 2 weeks; during peak periods it may be longer. If timing is critical for the Buyer, the Buyer undertakes to notify the Seller in advance to agree a feasible timeline.

4.4. Delivery is carried out by the selected carrier within Ukraine and abroad (where available). Cost/timelines depend on the carrier, weight/volume, and destination. The risk of accidental loss/damage passes to the Buyer when the Goods are handed over to the carrier under the waybill.

4.5. For international shipments, the Buyer may bear customs duties/taxes of the destination country according to local rules.

  1. Rights and Obligations of the Parties

 5.1. The Seller shall:

  1. a) timely produce (if applicable), assemble, and hand over the Goods;
  2. b) provide accurate information about the Goods (materials, sizes, care, purpose);
  3. c) ensure protection of personal data and proper customer support.

5.2. The Seller may: suspend/cancel an Order in case of the Buyer’s breach or suspected fraud; change prices/assortment as displayed on the Website; amend the Offer.

5.3. The Buyer shall:

  1. a) provide truthful data when placing an Order;
  2. b) pay for the Goods on time;
  3. c) accept delivery/pickup within the agreed period;
  4. d) follow the operating/care rules for the Goods and the safety requirements of the sport.

5.4. The Buyer may obtain information about the Order and exchange/return Goods as provided by law and this Agreement.

  1. Returns

 6.1. The Buyer may exchange/return non-food Goods of proper quality within 14 calendar days from the day following receipt, provided the Goods were not used and retain marketable condition, consumer properties, labels/seals, and the receipt (including an e-receipt). Law of Ukraine.

6.2. Certain categories of proper-quality goods are not subject to exchange/return according to the current List of Goods Not Subject to Exchange (Return) approved by Resolution of the Cabinet of Ministers of Ukraine No. 1243 dated 01.11.2024 (as amended). Law of Ukraine.

6.3. Custom (individually made) items are not subject to exchange/return as they are produced to individual specifications, except where substantial defects are identified. The content and scope of the List are defined by the CMU and may be further detailed by competent authorities. Law of Ukraine.

6.4. In case of a manufacturing defect, the Buyer submits a claim with evidence (photos/videos). After inspection/expertise, the Seller will repair, replace, or refund within the time limits prescribed by law. Law of Ukraine.

6.5. Return shipping costs for proper-quality goods are borne by the Buyer (unless otherwise agreed). Refunds are made by the same method used for payment (where technically possible).

  1. Liability

 7.1. The Parties are liable for non-performance/improper performance in accordance with the legislation of Ukraine and this Agreement.

7.2. The Seller is not liable for actions of carriers, payment services, or other third parties; for indirect damages (lost profits); or for consequences of the Buyer’s breach of the Goods’ operating rules.

7.3. Fencing equipment reduces risks but does not guarantee the complete absence of injuries. The Buyer agrees to follow safety rules, the instructions of coaches/competition organizers, and applicable sport standards.

  1. Confidentiality and Personal Data Protection

 8.1. Personal data is processed by the Seller in accordance with the legislation of Ukraine and the Privacy Policy posted on the Website.

8.2. The Seller applies organizational and technical measures to protect personal data from unauthorized access/disclosure.

8.3. The Buyer consents to the processing of personal data when placing an Order for the purposes of fulfilling the Order and service communications.

  1. Other Provisions

 9.1. This Agreement is concluded in electronic form under the Law of Ukraine “On Electronic Commerce” and has the legal force of a public contract/contract of adhesion (Civil Code of Ukraine). Law of Ukraine.

9.2. The Seller may amend this Offer by publishing a new version on the Website. For Orders already paid for, the version effective at the moment of acceptance applies.

9.3. For matters not regulated by this Offer, the Parties are governed by the legislation of Ukraine, including the Law of Ukraine “On Consumer Rights Protection”. Law of Ukraine.

9.4. Disputes are resolved through negotiations; failing agreement — by the courts of Ukraine at the Seller’s location.
